This privacy notice explains how TOOLPAD SAS, trading as AutoCut ("AutoCut," "we," "us," or "our"), processes personal data when you use AutoCut's websites, web account area, desktop application, Adobe Premiere Pro and DaVinci Resolve extensions, cloud APIs, transcription and AI-powered features, customer support, marketing communications, and related services (collectively, the "Services").

This notice applies to autocut.com, autocut.fr, any AutoCut domain that links to it, and the AutoCut software and services described above.

1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Depending on the Services you use, AutoCut may process:

Account and identity data: email address, account identifiers, authentication provider identifiers, and account preferences.

Subscription, licensing, and billing data: customer and subscription identifiers, license keys and status, purchase history, invoices, billing name, company name, billing country, payment status, and related billing metadata. Names and company names are collected only for billing. Payment card numbers and security codes are handled by payment processors and are not stored by AutoCut.

Device, application, and usage data: IP address, device and application identifiers, operating system, application and extension versions, language, feature usage, timestamps, diagnostic events, error reports, and crash information.

Customer support data: support email address, account identifiers, messages, attachments, and information you choose to provide while requesting assistance.

Customer processing content: when you use transcription or applicable AI features, the AutoCut desktop application extracts and uploads a low-quality audio track and processes the resulting transcript and job data. Project files, editing timelines, and videos never leave your device.

Website and marketing data: cookie identifiers, consent choices, referral information, campaign data, and website interaction data, subject to your cookie choices where required.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information, such as your Internet Protocol (IP) address and/or browser and device characteristics, is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies.

The information we collect includes:
Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).
Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

Directly from you, including during registration, purchase, support, and sales.

Automatically, from the AutoCut websites, applications, extensions, APIs, security systems, and diagnostic tools.

From service providers and integrations, including identity providers, payment processors, customer-support tools, and services you connect to AutoCut.

3. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process personal data for the following purposes:

Create accounts, authenticate users, and manage licenses: account, identity, and licensing data.

Process subscriptions, payments, refunds, and invoices: account, billing, transaction, and subscription data.

Provide transcription and AI-powered features: customer audio extracts, transcripts, job identifiers, and account data.

Provide support and resolve product issues: account, support, diagnostic, and relevant customer-provided content.

Secure, monitor, troubleshoot, and improve the Services: usage, log, error, and diagnostic data.

Send requested or permitted product and marketing communications: account and communication-preference data.

Comply with legal obligations and establish or defend legal claims: relevant account, billing, support, security, and transaction data.

Operate non-essential website analytics and advertising cookies: cookie and website-interaction data.

4. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.

5. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: AutoCut shares personal data only when necessary for the purposes described in this notice and only in the situations described below.

AutoCut shares personal data only when necessary for the purposes described in this notice, including with service providers that host, secure, monitor, support, bill for, or perform requested functions of the Services. These providers may process data only under AutoCut's instructions or under another lawful role identified in their terms and applicable law.

Current categories include cloud hosting and identity services; content delivery and edge services; transcription and AI processing; payment processing; customer support; application monitoring and availability alerting; product analytics; and professional advisers.

AutoCut may also disclose information where required by law, to establish or defend legal claims, to protect users or the Services, or as part of a merger, financing, acquisition, reorganization, or sale of assets.

Current providers and processing categories

Cloud database, identity, and object storage — Google Cloud / Firebase: accounts, identity, licenses, audio uploads, and Firestore source data for backups.

API and PostgreSQL hosting — Render: account and API data, transient transcripts, and statistics. Render deployments are documented in Frankfurt.

Edge, Workers, R2, TLS, and backups — Cloudflare: traffic processing, temporary audio, static delivery, and Firestore backups. Workers operate on the global edge.

Speech-to-text — Deepgram: customer audio with the no-retention option enabled.

Speech-to-text — Google Speech-to-Text: customer audio processed under a data processing agreement.

AI inference — Replicate: transient processing of customer audio or derived data.

GPU inference — RunPod: transient processing of customer uploads for AI inference.

Payments — Stripe, Paddle, and PayPal: customer and payment metadata. Cardholder data remains with the payment processors.

Support — Crisp: support email address, account identifiers, support conversations, and customer-provided attachments.

Error monitoring — Sentry: application error and diagnostic data under provider-managed retention.

Availability monitoring — Better Stack: availability and alerting data.

Product analytics and feature flags — PostHog: product usage and feature-flag data.

Search — Algolia: search processing used by the Services.

Secrets management — Infisical: production credentials; no customer-content purpose is documented.

General-purpose AI — OpenAI: AutoCut does not submit customer data to OpenAI.

6. WHERE IS PERSONAL DATA PROCESSED?

AutoCut is established in France. The Services use providers and infrastructure located in the European Economic Area and, for certain providers or global network functions, in other countries. Core services currently documented include Google Cloud / Firebase in the eur3 multi-region, Render services in Frankfurt, and Cloudflare's global edge network.

Where personal data is transferred outside the EEA, AutoCut uses an applicable transfer mechanism and supplementary safeguards as required by law. Provider locations and transfer mechanisms may change as the Services evolve.

7. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We use cookies and similar tracking technologies to ensure the proper functioning of our Services, improve user experience, and analyse usage.

We may use cookies and similar technologies (such as web beacons and pixels) to access or store information.

8. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law.

We retain each category of personal data only for the period needed for the purposes described above, subject to legal, accounting, security, dispute-resolution, and backup requirements. The applicable periods or criteria are described in this section. A verified erasure request overrides standard business retention unless AutoCut must retain specified information under law or another valid exception.

Account, identity, subscription, and licensing data: retained while the account is active and for up to three years after termination where needed for support, fraud prevention, legal claims, or legitimate business records; earlier deletion applies when required.

Uploaded audio and transient transcription data: deleted automatically within 24 hours according to the current service design.

Support communications and attachments: retained in Crisp until AutoCut deletes them manually or through the API; Crisp does not automatically expire conversation history.

Debugging or support copies of customer content: retained for no more than 30 days.

Financial and accounting records: retained for ten years where required by French accounting and tax law.

Security, audit, error, and operational logs: retained according to provider-specific settings and for only as long as needed for security, troubleshooting, service operation, legal obligations, or the establishment and defense of legal claims.

Firestore backups: daily backups are retained for a minimum of 30 days and each backup is protected by a 90-day immutable object lock. Lifecycle rules delete backups after the applicable retention and lock period.

Cookie and marketing data: retained according to each cookie's configured duration, consent choices, and the purpose for which it is used. Consent-based marketing data is deleted or suppressed when consent is withdrawn or it is no longer needed, subject to legal exceptions.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

9. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

10. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

The Services are not intended for, and may not be used by, anyone under 18. AutoCut does not knowingly collect personal data from anyone under 18. 11. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: In some regions, such as the European Economic Area (EEA), United Kingdom (UK), and Canada, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time.

In some regions (like the EEA, UK, and Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. We will consider and act upon any request in accordance with applicable data protection laws.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, or by contacting us using the details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below. You will then be removed from the marketing lists. However, we may still communicate with you, for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can:

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

Closing an account ends access to the Services but does not necessarily erase every record immediately. You may separately request erasure. AutoCut will delete or anonymize eligible data from active systems, retain only data covered by a valid legal exception, and allow deleted data to expire from protected backups according to the published backup window.

12. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

13. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
